MODAMICA.IT - Shipping and returns

GESTIMODA S.r.l. ships all over the world via DHL and in Italy through UPS In compliance with the international import/ export laws, the goods shipped are matched with a proforma invoice which declares the total value of the goods purchased in Euro. The invoice shows the value of each individual item purchased.
GESTIMODA S.r.l. can not be held responsible for delays in shipments caused by weather conditions, international customs issues or other circumstances unrelated to its control.
Orders are processed for shipping by GESTIMODA S.r.l. from Monday to Friday 11: 00 am-5: 30 pm (CET). Orders placed from Friday to Sunday will be processed on the following Monday.
Orders related to the available items, upon confirmation of the availability of the items and verification of the bank transaction, are shipped the day after the order is received. The amount of credit card transactions is charged immediately when the order is processed and following a transaction verification by the Bank. In all cases, GESTIMODA S.r.l. reserves the right to postpone the shipment if the order can not be sent for reasons beyond its control. Please note that there may be delays in shipping during promotions and sales.

Deliveries take place during working hours from Monday to Friday, excluding holidays. The courier will make 2 delivery attempts; after the third, the order will return into our warehouse. All orders are processed automatically and we are not able to change shipping and delivery times.


FAILURE TO DELIVER

If, under any circumstances, an order is not delivered to the address indicated by the Client due to his non-cooperation (wrong telephone number, wrong address, lack of address, lack of compliance with the import rules), as per the commercial agreement, the package could be sent back to Italy at the expense of the Client, including the import taxes. These expenses will be deducted from any possible reimbursement.


Delivery times and shipping costs will change depending on the type of delivery. You can choose between home delivery or pick-up at the store.

It is not possible ship to Russia.


In Italy delivery takes place within 24-48 hours, after 24 hours from the date of registration of the order. For customized products, delivery may take one or two days longer. Possible delays in delivery may be caused by the temporary unavailability of products, malfunctions in the courier service, for  reasons of force majeure, or in the case of holidays. If you do not receive the product in 5 working days (excluding Saturday and Sunday), please contact the customer service at customercare@modamica.it. Delivery times for orders placed from Monday to Friday, before 13:00 (CET), will be 2 working days for Express deliveries and 24h in case of Urgent delivery. If the order is placed after 1:00 pm (CET), on weekends or on public holidays, delivery will require one more day.

In Europe and in the rest of the world delivery takes place within 2-4 days, after 24 hours from the date of registration of the order. For customized products, delivery may take one or two days longer. Possible delays in delivery may be caused by the temporary unavailability of products, malfunctions in the courier service, for reason of force majeure or in the case of holidays. If the delivery have exceeded the 8 working days (excluding Saturday and Sunday), please contact the customer service at customercare@modamica.it.

A tracking service is active for the UPS and DHL courier.
In case of absence of the recipient, the courier will leave a notice. The delivery will be attempted twice: then, if not, the package will return to our Store.
During the order compilation it is important to indicate a correct telephone number (fixed number or mobile number), to facilitate the resolution of the delivery practice. It is important to indicate a delivery address where someone is present who can pick up the goods. Furthermore, it is important to always indicate the surname present on the intercom.
The courier advises the customer by e-mail about the status of the shipment. The service is activated automatically if the field relating to the e-mail address is filled in correctly.
Please do not insert a PO BOX in the address field, the courier would not be able to deliver the goods purchased. Therefore, a physical delivery address must be entered.
In case of deliveries made at the reception (with signature for collection by the receptionist), we will not be responsible for subsequent non-delivery of the package to the final recipient.
If a destination country is not among those listed means that currently is no plans to deliver the products in that country.

It will not be possible to send orders to military bases or mailboxes.


Possible Delays

Payments need an automatic check by the bank that issued the credit card, this verification could cause a delay in shipping orders.
Once the payment (by credit card or PayPal) will be authorized, it will be credited to the Modamica.it account and the order will be processed as soon as possible.
Orders are processed and delivered to the courier for shipment in chronological order, based on the time of receipt. Orders with "express shipping" have always priority over “Standard shipping orders. In weekdays (from Monday to Friday) orders are processed within 24 working hours from the time they are placed.

In specific times of the year, on the occasion of public holidays (during which the couriers do not ship) and in times of big order traffic, that we have listed below, handing time may delay up to ¾ days:

  • January 1st and 6th
  • Easter and Easter Monday
  • April 25th
  • May 1st
  • June 2nd
  • August 15th
  • November 1st
  • December 8th, 25th and 26th
  • Black Friday, special offers etc...



Home delivery

Consult the status of the order at any time by entering My Orders section in My Account. If you have not registered on Modamica.it, you can directly access the Orders section. In this case you will have to enter your e-mail address and the order code. Also, when your order leaves our warehouses, we will send you an email.

Pick up in store

If you have selected the pick up at our store, we will send you an e-mail to inform you that the order you made is ready and available at our store. You will have maximum 15 days to collect your order. Ask directly to our staff in store and pickup your order showing an identity document.


In case of shipping to a Country not belonging to the European Union, the merchandise might be subject to custom duties or eventual taxes. Every additional charge connected to the custom will be exclusively incumbent upon us excluding Russia.

In case of shipping towards Russia, the merchandise might be subject to custom duties or eventual taxes. Every additional charge connected to the custom will be exclusively incumbent upon the recipient.  Some Russian regions are subject to particular Customs regulations which set a limit of weight and value to the importation of goods, that we list here below:

  • 200€ per shipping, for a maximum amount of € 1000 a month for each entity;
  • 1000€ a month for every shipping, for a maximum weight of 31 kg, for each shipment.

The exceeding of these limits implies the increase of customs duties to up 30% of the total value of the goods.
In case of refusal of the merchandise from the client or the failure to delivery for any other reason (ex. Wrong address and/or telephone number; repeated absence of the recipient, etc.) the amount covering the following expenses will be held: shipping merchandise + return merchandise + custom duties for the return, they will be charged to the recipient. It will be, on the other hand, refunded the merchandise value.

Custom duties and eventual taxes will vary according to the Country of destination and they will be applied when the merchandise enters the Country itself. For further information regarding the amount of custom duties and eventual taxes and the methods of custom clearance, please contact the custom offices in charge in the respective countries.



  • RIGHT OF WITHDRAWAL

You have the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquire the physical possession of the item. If you have purchased multiple Items with a single order, the withdrawal period will expire after 14 days from the day on which you or a third party, other than the carrier designated by you, acquire the physical possession of the last Item.

To exercise the right of withdrawal, you are required to inform us (by post at the address "Gestimoda srl, Via GB Rubini, 26 -24030 Valbrembo (BG)", or via email at returns@modamica.it) of your decision to withdraw from the purchase contract by an explicit declaration. You can use the withdrawal form attached as “Attachment 1” to these General Conditions, but it is not mandatory.

To comply with the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. Once we have received the request for withdrawal, we will notify you without delay an acknowledgment of receipt by email.

In case of your withdrawal from the purchase contract, you will be refund for all the payments you made in our favor, including delivery costs (with the exception of additional costs resulting from your choice of an other type of delivery different from the less expensive type of standard delivery offered by us), without undue delay and in any case no later than 14 days from the day we were informed of your decision to withdraw from the purchase contract.
These refunds will be made using the same payment method used by you for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a consequence of such reimbursement.

If you have exercised the right of withdrawal with reference to the purchase of an item, unless we have offered to withdraw this Article, please return the Article or deliver it to us without undue delay and in any case within 14 days from the day in which you have communicated your withdrawal from the purchase contract.

The deadline is met if you returned the Items before the 14-day period expires. The Articles must be returned to the following address: Gestimoda srl, Via G.B. Rubini, 26 -24030 Valbrembo (BG). The costs of returning the items will be at your charge, unless you have chosen to use our free pick-up service.

In case of exercising the right of withdrawal from the purchase of items, the refund may be suspended until the receipt of the items or until the demonstration by you of having sent the items, if previous.
You will be held responsible only for the decrease of the value of the items resulting from an handling of the items different from that necessary to establish the nature, characteristics and functioning of the goods.

You are required to return the items in an intact state of conservation and with original labels not removed. The packaging of the items must be accurate, in order to safeguard the original envelopes from damage, apposition of text or labels.

The right of withdrawal is excluded, in particular, in the following cases provided for by the Consumer Code:

  1. the supply of tailor-made or clearly personalized goods (including personalized items as per article 4.12 of the General Conditions);
  2. the supply of sealed goods that can not be returned for hygienic reasons or related to health protection and have been opened after delivery. Therefore, for example, for reasons of hygiene, briefs, thongs and culottes are provided with a protection system which prevents them from being tried or used. If you wish to return this type of item, you must keep the label and the protective device.

Free Return in store

If the item purchase does not please you, you have up to 14 days from the reception of it to exchange it with a different size or to ask for its return. It’s very simple!

  1. Send an email to customercare@modamica.it specifying if you want to change size, color or receive a refund. Modamica.it may request, if deemed necessary, a photograph of the product to check its status in order to accept or not accept the return.
  2. Deliver the item you want to return or exchange at the cashier desk.
  3. Refunds will be made in the original method of payment
    Important: if you return your items in store, all data connected to your return will be sent to our office where the refund will be generated in the original method of payment.


Free pick-up return

You have up to 14 days from the reception of the order to exchange the items with others of a different size or to ask for a refund. To this end, you can request free pick-up at your address. We will send a courier to pick-up the package:

  1. Send an email to customercare@modamica.it specifying if you want to change size, color or receive a refund. Modamica.it may request, if deemed necessary, a photograph of the product to check its status in order to accept or not accept the return.
  2. Modamica.it will send you and email with return code, you have to write it on the tag applied to the product through the warranty seal, and a label of return.
  3. Prepare the package with the label of the return: Wrap your items in a secure way, the seal of guarantee must be intact with no tampering. If possible, use the original package and insert the previously printed invoice.
  4. The delivery service will come to your address to pick up the package: We will send you an e-mail to confirm a date and a time slot for the collection of the items. In case of return, the refund will be made in the original method of payment within 3 to 12 working days starting from the date when the package arrives to our warehouse.


Return conditions

In case of exchanges and return, you must understand that:

  • All returned items must be in their original condition, not damaged.
  • The seal of guarantee must be intact, it must not be tampered, broken or removed. Otherwise the return won’t be accepted
  • The right of withdrawal does not apply: in the case of (a) the supply of tailor-made or clearly personalized goods (including personalized items as per article 4.12 of the General Conditions); (b) supply of sealed goods that are not suitable for being returned for hygienic reasons or related to health protection and have been opened after delivery. Therefore, for example, for reasons of hygiene, briefs, thongs and culottes are provided with a protection system which prevents them from being tried or used. If you wish to return this type of item, you must keep the label and the protective device.
  • As soon as we receive your package, we will check the status of the items and we will replace the size or color or refund the returned items. If you voluntarily choose to return the item to us using a different shipping method, you will support the shipping costs. In case of return by post, Modamica.it does not accept shipments charged to the recipient or cash on delivery.

Attachment 1 - Exercise form of the right of withdrawal



The items sold on the website to users that act as customers (or for other purposes excluding entrepreneurial, commercial, artisan or professional activity possibly practiced) are covered from a legal warranty of compliance with the art. 128-135 of the “Codice del consumo”.
There is a lack of compliance in the following cases:
  1. The item is not suitable for the use for which is commonly known and used for.
  2. The item does not comply with the description made by us on our website and it does not show the characteristics of the item presented.
  3. The item has the same characteristics and performance that such items usually have and that someone can reasonably expect, given the nature of the item and given the public description of its characteristics specified on our website by us, by its manufacturer or by its agent or representative, especially in advertising or on its label.
  4. The item is not fit for the particular use you were thinking of and you brought it to our attention at the moment we finalised the contract and that we accepted

You can ask us, upon your choice, to repair an item or replace it, with no further expenses in both cases, except in the case where the required repair is objectively impossible or excessively expensive with respect to the other. You can ask us, upon your choice, a fit reduction in the price or the termination of the contract when one of the following cases happens: i) the repair and the replacement are impossible or excessively expensive; ii) we haven’t repaired or replaced the item within a reasonable amount of time; iii) the replacement or the repair has caused you great damages.

If you have found a lack of conformity of an item purchased on the website, please contact us immediately through email customercare@modamica.it or through postal service at “Gestimoda S.r.l., Via Gian Battista Rubini 26, 24030, Valbrembo (BG), Italia”.

We will respond you as soon as possible with all the indications on the specific procedure to follow and on the available remedies, given the nature of the item and the type of lack of conformity declared. 

 
• REFUNDS

We work and accept a return within 3 working days from its delivery to our warehouse. In particularly busy moments, refunds can require up to 12 working days. After we accept the return, we will immediately proceed with the refund and we will send a confirmation e-mail. The refund will be made using the same payment method used at the time of purchase.

The amount will be totally refunded only if has been chosen the free shipping during the order phase.
In case of paid shipping, the shipping costs will be withheld.

The time it takes to obtain a refund varies depending on the payment method:

Credit card: our bank will proceed with the refund within 7 working days starting from the moment we send an e-mail confirming the acceptance of the return. The required time to see the refund on your bank account depends on the Institute issuing of the card itself.

PayPal: the refund will be visible on your PayPal account within 24 hours from the reception of the e-mail confirming the return.

Cash at the delivery: the refund will be executed as a credit transfer on your bank account or postal account indicated during the return procedure. 5 euros will be detracted from the amount reimbursed representing the cost of the marking service. The amount will be visible on your banking account within 10 working days from the reception of the e-mail confirming the return.

If you decide to return an item to us using a shipping method chosen by you, without using our free pick-up service, the shipping costs for returning the item will be at your expense.
